In Gestational Surrogacy the surrogate is carrying a child or children without contributing an egg from her body.   Florida statute provides that the gestational carrier has no rights to custody of the child or children she is carrying.

In a Traditional Surrogacy arrangement, generally, the surrogate is using her own egg that is artificially inseminated with the sperm of the Intended Father. These are called pre-planned adoptions and the surrogate has 48 hours after she gives birth where she may rescind her consent to surrender the child.

We provide legal services necessary to protect the rights of all parties to the egg donation process.   An egg donor may be used where an Intended Mother is able to carry a child but is unable to use her own eggs. An egg donor may also be used in connection with gestational surrogacy.

Embryo Donation

In some instances, couples going through In Vitro Fertilization have excess embryos created that they are not able to use for themselves. These embryos usually have been frozen and will either be kept in that frozen state sometimes indefinitely, or destroyed. Some couples, with the knowledge that there are many couples unable to conceive a child, choose to donate these “excess embryos” to another couple.

In Florida, the donor of any embryo relinquishes all maternal or paternal rights and obligations with respect to the donated embryos or the resulting children. Florida permits only reasonable compensation directly related to the donation of embryos to be paid to the donor.

The decision to make an adoption plan for your child is a challenging one and is perhaps the most difficult decision a person might make.  We understand your fears, concerns and your desire to find a loving, caring and secure home for your child.

We are here to assist and guide you in every step in making your adoption plan.

All prospective adoptive parents must undergo a thorough home study process. A licensed social worker evaluates the family to assure a safe placement. The prospective adoptive family, must have a criminal and child abuse background check performed, document a stable financial history, if married must have a stable and loving marriage, and a medical evaluation that does not show any life threatening illnesses. In the best interest of the child, the family’s attitudes towards adoption are also evaluated.

We represent prospective adoptive families living in the State of Florida and elsewhere. As the parent choosing an adoptive placement for your child, you have the option to select the family. You may meet and spend time with the family of your choice.  Many women request that their adoptive parents attend sonograms, prenatal appointments and/or the birth of the child.  Most adoptive families are thrilled to be a part of this experience. Telephone, electronic and written communication during your pregnancy is also available at your request.

After your child’s birth, you may elect to receive periodic pictures and letters discussing your child’s growth and development. All communication is conducted with a level of privacy to protect the identity of all parties involved in the process.

Adoptive parents

The decision to adopt a child can be a stressful and emotional one.  Many adoptive parents have undergone years of infertility treatments prior to making the decision to adopt.   We understand the emotional roller coaster that the majority of you have experiences just to reach your adoption decision.   Once you have reached your decision, your choice of hiring an attorney will be the most important factor in your adoption experience.

We understand the very personal  and confidential nature of adoptions, and we meet in person with all prospective clients.  In our first meeting, we will not only explain our services but also offer the opportunity to make sure we are the right fit for you.    We work with a limited number of adoptive parents at a time, thus enabling us to focus on your particular needs and to increase the opportunity for a quick and successful match with a birth mother.

We manage the entire legal process through the finalization of the adoption.  We guide our adoptive parents through the entire process, hold their hands and offer a shoulder when needed, and gently attempts to ease any stress that may arise. We will only refer other needed professionals that share his sense of compassion, responsibility and reliability.

The most important portion of your adoption is ensuring that the legal documents are properly prepared and provided to the Courts.  We prepare all legal documents necessary, closely evaluate each situation, fully advise our clients on potential issues in the adoption, provide outreach and other resources, and perform all legal work toward the finalization of the adoption.
